The course will be taught in English in the beginning of the IV period. The preliminary theme of the lectures is "The multi-level protection of human rights in Europe through the interaction among ECtHR, CJEU and Constitutional Courts".
The lectures will cover the following topics:
1) The concept of law and protection of human rights: aspects of legal theory (Prof. D’Alessandro)
2) International, EU and domestic law related to the protection of human rights in the Italian Constitutional Court’s perspective (Prof. D’Alessandro).
3) The supreme principles of the Constitutional order as a limit for EU law: the “counter-limits” doctrine and the “Taricco” saga (Prof. D’Alessandro).
4) In search of “the system of systems” of human rights protection in Europe: the interaction among the domestic, ECHR and EU systems of human rights protection according to the relevant norms (Prof. Colacino).
5) A matter of principle(s): fair balance, margin of appreciation, hierarchical supremacy and the “best-protection” clause (Prof. Colacino).
6) The Italian Constitutional Court approach from the “twin” judgments of 2007 and the gradual “internationalization” of the domestic jurisdictions (Prof. Colacino).
